Are you at risk of losing your tax exempt status? The IRS had announced that those organizations that did not file a return in 2007, 2008, 2009 would be at risk of losing their exempt status (some exceptions apply). Due to the number of organizations that would have lost their exemptions, the IRS extended the filing deadline for small nonprofits to Oct. 15, 2010. Now that we are past those dates; Section 6033(j) of the Internal Revenue Code automatically revokes the exemption of any organization that fails to satisfy its filing requirement for three consecutive years. The automatic revocation of exemption is effective as of the due date of the third required annual filing or notice. A notice is normally sent to the organization at the address on file with the IRS. Please note: Most nonprofit organizations are required to file an annual report every year. Fund raising through your organization's website falls under a "fussy" category and the details are too long to go into on this site. Most state's registration law requires registration before the first solicitation has been directed into the state. In our experience many nonprofits have launched fundraising campaigns prior to understanding or being aware of the state's law. Please be aware that it is never too late to comply. Failure to register before soliciting is a violation of law and could subject the organization and at times its Board, to monetary penalities and/or whatever sanctions exist in each state's law.
